1. INTRODUCTION AND COMPANY INFORMATION
In compliance with the duty of information requirements in article 10 of The Information Society Services and Electronic Commerce Spanish Act 34/2002, of the 11th of July, 2002, the following is hereby stated :
EUROPAIR BROKER, S.A. (hereafter Europair Broker) is an entity whose registered office is situated in Calle Cristóbal Bordiú, 22, Local E, 28003 Madrid, Spain. The company, Tax ID Number A07663354, is registered in the Companies Registration Office of Madrid, Volume 14911, Document 33, Page M-248206, Entry 2ª and it is also registered in the "Registro de la Subdirección General de Empresas y Actividades Turísticas de la Comunidad de Madrid" with CICMA (travel license) number 2627. The domain name registered by Europair Broker is europairbroker.es (hereafter www.europairbroker.es or Web Site). Europair Broker may be contacted directly at the registered office address. Notifications and requirements related to the present General Conditions of Use must be put in writing and hand-delivered or sent by registered post to the address of the Europair Broker registered office.
2. OBJECT AND SCOPE OF APPLICATION
Access, navigation and/or use of the portals and services of Europair Broker confer the condition of user (hereafter Users) and imply acceptance of the General Conditions of Use stated here. These General Conditions of Use regulate access, use and navigation of the Web Sites of Europair Broker (including news commentaries, blogs, forums, etcetera), as well as the responsibilities deriving from the use of the services and contents (hereafter understood by “contents” the texts, images, graphics, drawings, photographs, audio, videos, news, as well as any other creation protected by national laws and international treaties concerning copyright and patent rights). Access to or use of www.europairbroker.es by the Users implies acceptance and adherence to these General Conditions of Use. Independent of these General Conditions of Use, Europair Broker may establish particular conditions, which will regulate the contracting of products or specific services offered to the Users, and which, depending on the case, will replace and/or modify the present General Conditions of Use, with the terms of the particular conditions - which may contradict the General Conditions - prevailing over the General Conditions of Use.
3. ACCESS
Use of the Services and access to the contents supplied by www.europairbroker.es is free of charge. However, some of these services and contents offered by Europair Broker to third parties through the Web Site may be subject to special conditions of contracting and payment, as is clearly indicated in each case. The contracting of products and services through www.europairbroker.es by minors is prohibited, unless they possess previous and express permission from their parents, tutors or legal representatives, who will be considered responsible for the actions of the minors in their charge, in accordance with current legislation.
4. USE OF THE PAGE
The User commits to using the information and the services provided by Europair Broker in accordance with the law and with the present General Conditions of Use, and to abstaining from using the Services with illicit or conflicting aims or ends to those established in the General Conditions.
The User agrees that and is aware that the following services do not accept advertisements, chain emails or any other content that is not opinion or debate on articles or news items; commentaries on news; blogs; and the sending of information via forms, as well as any other service that allows the publication of the opinions of the Users. When using the services, the User promises not to use them to send messages that defame or insult, or which contain false information, or that which is inappropriate, abusive, harmful, pornographic, threatening, or damaging to the public image or private life of third parties or that which for whatever reason infringes any law.
The User promises not to gather any information the purpose of which is to advertise, not to send any type of online advertising and not to transmit, to spread or to make available to third parties - through the services provided by Europair Broker - information, messages, graphics, sound or image archives, photographs, recordings, software and, in general, any type of material, data or contents that – and this is not an exhaustive list – (i) incur illicit or illegal activities or any which oppose good faith and public order; (ii) in any way contravene, ignore or threaten the fundamental rights and public freedoms recognised constitutionally and/or by international treaties and/or the rest of the legal system; (iii) induce, incite or promote actions, attitudes or discriminatory ideas by reason of sex, race, religion, beliefs or age; (iv) are protected by any copyright or patent rights whatsoever pertaining to third parties, without the User having previously obtained from the owners the authorization necessary to use them as he or she is using them or potentially may use them; (v) that violate the business secrets of third parties; (vi) that infringe the regulations regarding privacy of all communications.
5. COPYRIGHT AND PATENT RIGHTS
This Web Site is subject to Spanish law and to national and international legislation regarding copyright and patent rights. Europair Broker, whether as proprietor or as licensee is the holder of all the copyright and patent rights of the Web Site and its contents, and reserves exclusive rights to the same. The reproduction, distribution and publication of all or part of the same, in any manner whatsoever is expressly forbidden, except with the previous authorisation of Europair Broker and in accordance with what is declared in article 32.1 of the Texto Refundido de la Ley de Propiedad Intelectual (Consolidated Intellectual Property Law). The User may view, print, copy or store the elements and contents of the Web Site whenever he or she chooses, but only and exclusively for the User’s personal and private use and never for public or commercial purposes.
The User will abstain from manipulating, evading or altering any of the security or protection systems of the Web Site.
Under no circumstances will it be understood that access and navigation of the Web Site by the User, or the use, acquisition and/or contracting of products or services, implies renunciation, transmission, licensing or total or partial surrender of said rights on the part of Europair Broker.
All unauthorised commercial use or sale of the same is completely prohibited without written authorisation by Europair Broker.
6. COMMUNICATIONS LICENCE
Users who send or provide information to Europair Broker must always declare and guarantee that they are not infringing copyright, brand rights, patent rights or any other third party rights. The User agrees to accept responsibility and will not hold Europair Broker accountable for any communication that he or she supplies personally or in his or her name, extending said responsibility, with no restrictions, to the accuracy, legality, originality and ownership of the same.
7. PROTECTION OF DATA
In accordance with current legislation, which makes reference to information society and electronic commerce data protection services, the User who, in order to access services of www.europairbroker.es www.europairbroker.es inputs personal information, accepts that this be incorporated into files owned by Europair Broker, with the aim of offering the requested services, and keeping the User informed, whether by email or any other medium, of new features, products and services of Europair Broker and their third party collaborators.
In the case of communication by email, the User gives their express consent to be sent advertising by this means. Under no circumstances will his or her personal information be passed to third parties. The User has the option of exercising his or her rights of access, rectification, cancellation or objection as regards his or her personal information by writing an email to this address : mailing@europairbroker.es.
8. RESPONSIBILITIES AND GUARANTEES
Under no circumstances will Europair Broker be held responsible for the reliability, utility, veracity or accuracy of the services or of the information provided through the Web Site. Therefore, Europair Broker will not be held responsible for (i) the continuity of the contents of www.europairbroker.es and the absence of errors in said contents ; (ii) the absence of viruses and/or other malicious or negative elements on the Web Site or on the server which administers it; (iii) the invulnerability of the Web Site and/or the impregnability of the security measures that it adopts; (iv) the poor utility or performance of the contents and products of the Web Site (v) legal damages that are caused to themselves or to a third party by any person who either infringes the conditions, rules and instructions which Europair Broker establishes on the Web Site, or who violates the security systems; (vi) incorrect, inappropriate or illicit use of information on the Web Site. The User will be held responsible for breach of the obligations to which he or she is subject by virtue of the General Conditions of Use and of the law which pertains to the use of these services.
9. LINKS
Europair Broker assumes no responsibility whatsoever for contents or services that may be accessible through links which it is possible to access from the Web Site via other links, buttons or banners.
In addition, connections and links from www.europairbroker.es with other unassociated websites do not imply any type of relationship, collaboration or interdependency between Europair Broker and those responsible for the unassociated web sites.
Any entity or user who would like to establish links from other places to www.europairbroker.es may link with any page forming part of the Web Site, but the link must be absolute and complete, that is to say, it must take the User, with one click, to the URL address of the Europair Broker page and must completely cover the screen with the page which it links to. Under no circumstances, except with the express written permission of Europair Broker, may the Web Site which makes the link reproduce, in any form whatsoever, the Web Site; include it as part of its Web or within one of its "frames"; or create a "browser" on any of the pages of the Web Site.
On the page on which the link has been established, it may not be stated in any way that Europair Broker has authorised said link, without express and written authorisation.
Europair Broker does not authorise the setting up of a link to the Web Site from those Web pages which contain illicit, illegal, degrading or obscene information or content or that which largely contravenes morality, public order or generally accepted social norms.
10. RIGHT OF EXCLUSION
Europair Broker reserves the right to deny or remove access to the Web Site and the services and contents it offers, without warning, to those Users who breach the General Conditions of Use.
11. MODIFICATIONS
Europair Broker reserves the right to modify the presentation and the configuration of the contents and services of the Web Site, and to add, remove or modify any content or service without prior warning.
12. MODIFICATIONS OF THE PRESENT CONDITIONS
Europair Broker reserves the right to modify without prior warning the General Conditions of Use, that are published on the web site and may be accessed by the user at any time. Modifications of the same will be considered notified when they simply appear at www.europairbroker.es
13. APPLICABLE LEGISLATION AND JURISDICTION.
The established relationships between Europair Broker and the User are governed by current Spanish legislation and any dispute will be submitted to the Juzgados y Tribunales [Courts of Justice] of the city of Madrid; the parties expressly waive any other jurisdiction to which they may be entitled.
